Resolution Process and Limited Service Guarantee
Terms and Conditions
The following are the terms and conditions applicable to the HomeProHub Resolution Process and Limited Service Guarantee. By using the HomeProHub services, you agree that you are bound by the following terms and conditions, as well as HomeProHub's Terms of Service (the "Terms of Service"). RESOLUTION PROCESS AND LIMITED SERVICE GUARANTEE.
Resolution Process: To be eligible for the Resolution Process and the Limited Service Guarantee, you must be a "Homeowner", as defined in the Terms of Service, who has agreed to be bound by the Terms of Service, and have used a "Certified Contractor", as defined in the Terms of Service, who you learned about through the HomeProHub service. You must also have entered into a written contract or agreement with a HomeProHub Certified Contractor within 30 days from the date of selection of the winning bid. The Resolution Process and Limited Service Guarantee are not applicable under the following circumstances:
- Work that is performed without a written contract or agreement signed by both parties;
- For work performed by someone other than a HomeProHub Certified Contactor;
- For any materials, equipment appliances or other machinery, whether or not provided by you or the Certified Contactor;
- For work altered by you or any other party except the Certified Contactor;
- For work that extends beyond the scope or description of the original bid selected.
Documentation: HomeProHub takes all complaints against any Certified Contractor seriously. To initiate the Resolution Process, we request that all complaints be thoroughly and accurately documented in writing and copies of all related documents, including original signed contracts or agreements, evidence of payments, signed change orders, etc. be provided up front. Should you choose to lodge a written complaint against a Certified Contactor you are acknowledging that HomeProHub may share your complaint with the Certified Contactor. All Homeowner complaints related to a "Project," as defined in the Terms of Service, that are provided to HomeProHub are recorded and added to the Certified Contactor's file for evaluation purposes and the Certified Contactor is notified so that they can, if applicable, correct their practices to conform to HomeProHub's 25 point contractor certification process.
Facilitating Communication: Our experience shows that in most cases, communication between you and the Certified Contactor can resolve most problems. HomeProHub will, at the request of a Homeowner or a Certified Contactor, attempt to contact the other party and relay specific concerns. We will endeavor to help both parties reach a mutually acceptable resolution to any disputes. HomeProHub is not responsible or liable to either the Homeowner or the Certified Contactor if a mutually acceptable resolution is not reached. The mediation will be in accordance with the mediation terms of the Terms of Service.
Limited Service Guarantee: In the event that a Homeowner and a Certified Contactor have irreconcilable differences and are still unable or unwilling to agree upon a resolution pursuant to the Resolution Process, the Homeowner may be eligible for the Limited Service Guarantee. To be eligible for the Limited Service Guarantee, the Homeowner has to:
- Have provided accurate and truthful information via the "Project Posting," as defined in the Terms of Service;
- Have entered into a signed (by both parties) written "Project Agreement," as defined in the Terms of Service, with a Certified Contactor that the Homeowner learned about through the HomeProHub service;
- Have supplied HomeProHub with a written complaint regarding the Certified Contactor's workmanship or service and provided all required documentation;
- Have complied with any request by HomeProHub for an evaluation of the Homeowner's complaint by a third party evaluator designated by HomeProHub to determine if work was not completed or was defective ("Defective Work");
- Be willing to have another HomeProHub Certified Contactor complete or remedy the Defective Work as determined by HomeProHub;
- Have met all requirements described herein.
Amendments: HomeProHub may amend or eliminate the above services at any time by revising the foregoing terms on its Website.
